Jibe provides this Privacy Policy to inform users of our policies and procedures regarding the collection, use and disclosure of personally identifiable information received from users of. or otherwise collected through, the jibe wireless mobile application, text messaging, SMS, MMS, and other services that enable you to communicate or to upload, view, use and share content and transmit it to and from any mobile phone, computer or other connected device (collectively, the “Service”). This Privacy Policy may be updated from time to time for any reason; each version will apply to information collected while it was in place. We will notify you of any material changes to our Privacy Policy by posting the new Privacy Policy through the Service. You are advised to consult this Privacy Policy regularly for any changes.

By using the Service you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. “Processing” means using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States. If you reside outside the U.S. your personally identifiable information will be transferred to the U.S., and processed and stored there under U.S. privacy standards. Information Collection and Use

Jibe collects user submitted information such as name, email address, phone number, and age to authenticate users and to send notifications to those users relating to the Service. In some cases, jibe will also gather data from integrated web services and websites that the user may utilize the Service on.

Jibe also logs non-personally-identifiable information including time zone, profile information, aggregate user data, and device type, from users of the Service. Such data are used to manage the Service, track usage and improve the Service. This non-personally-identifiable information may be shared with third-parties to provide more relevant services and advertisements to members. User IP addresses may be recorded for security and monitoring purposes.

User information, including users’ pictures and user names, are displayed to people in order to facilitate user interaction. Email addresses or phone numbers may be used f to send notifications related to the Service. With the exception of notifications, a user’s email address and phone number is not shared or displayed to others. To facilitate searching and finding interesting content through the Service, jibe may allow users to search for other members using first and last name, email address, and other standard search strategies.

We may also use a user’s email address or phone number to send updates, a newsletter or news regarding the Service.

Phone Communications

You may use jibe to initiate or receive phone calls which are partly or fully handled via jibe telecommunications partners. Therefore any information which you may communicate during such phone calls, including any personal information shall not be deemed private. jibe cannot guarantee the security of such information, that you disclose or communicate in such phone calls and you do so at your own risk. This risk is similar to that incurred when using normal mobile and fixed line phone services.

Use of Cookies

Jibe uses cookies to store visitors’ preferences and to record session information, for purposes including ensuring compliance with our terms and policies, to improve the user experience with our services, and to customize Service content based on device type and user profile information. You may be able to configure your browser to accept or reject all or some cookies, or notify you when a cookie is set — each browser is different, so check the “Help” menu of your browser to learn how to change your cookie preferences. However, cookies are necessary for the full functionality of the Service. We do not store passwords, phone numbers, or other critical user data in cookies. Please note that jibe may allow third party advertisers that are presenting advertisements on some of our pages to set and access their cookies on your computer. Advertisers’ use of cookies is subject to their own privacy policies, not the jibe Privacy Policy. The term cookies shall be used to refer to all methods of storing user information via a web browser or otherwise.

Jibe may contain links to other web services or web sites. Jibe is not responsible for the privacy policies and/or practices on other services or sites. When linking to another service or site a user should read the privacy policy stated on that service or site. Our Privacy Policy only governs information collected through jibe. jibe is also integrated to other services and sites and when accessing portions of the Service that are controlled by other parties those parties policies shall apply.

Public Postings

Please be aware that whenever you voluntarily post or communicate public information through the Service that information can be accessed by the public and may in turn be used by those people to send you unsolicited communications.

User’s Usage of Other Users’ Data

The Service may allow you limited access to other users’ registration data, personal information or other information (“User Information”). Such User Information, if disclosed to you, is disclosed to you only for the purpose of using the Service in accordance with the terms and conditions of the Terms of Service and this Privacy Policy.

You hereby agree that you shall use any User Information only: (a) in connection with the Service, and (b) for any other purpose that the owner of such information expressly agrees to. In all cases, you must comply with any request by any user to delete any User Information of such user from your database. In addition, under no circumstances, except as defined in this Section, may you disclose User Information of other users to any third party without jibe’s express written consent and the express written consent of the relevant user.

Jibe and its users do not tolerate spam. Therefore, without limiting the foregoing, you are not permitted to add any user, whose direct contact information was disclosed to you in connection with any use of the Service, to your mailing list without such user’s express written consent after adequate disclosure.

Correcting/Updating or Removing Information

Jibe users may modify or remove any of their personal information at any time by logging into their account and accessing the edit profile feature. For personal information maintained on integrated or partner web services or websites users may utilize those sites to update and/or remove their information. A user may remove these sites from their jibe profile at any time through the jibe accounts feature.

Third Party Advertising

Advertisements appearing through the Service may be delivered to users by jibe or one of our advertising partners. Our advertising partners may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement. In this way, ad servers may compile information about where you, or others who are using your computer, saw their advertisements and determine which ads are clicked on. This information allows an ad network to deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy covers the use of cookies by jibe and does not cover the use of cookies by any advertisers.

Security

Jibe is very concerned about safeguarding the confidentiality of your personally identifiable information. We employ administrative, physical and electronic measures designed to protect your information from unauthorized access.

Sharing and Disclosure of Information jibe Collects

Except as otherwise described in this Privacy Policy we will not disclose personal information to any third party unless we believe that disclosure is necessary: (1) to conform to legal requirements or to respond to a subpoena, search warrant or other legal process received by jibe, whether or not a response is required by applicable law; (2) to enforce the jibe Terms of Service Agreement or to protect our rights; or (3) to protect the safety of members of the public and users of the Service. Jibe reserves the right to transfer personal information to a successor in interest that acquires rights to that information as a result of the sale of jibe or substantially all of its assets to that successor in interest.

Our Policy Towards Children

The Service is not directed to persons under 18. If a parent or guardian becomes aware that his or her child has provided us with personally identifiable information without their consent, he or she should contact us at support@jibemobile.com . We do not knowingly collect personally identifiable information from children under 13. If we become aware that a child under 13 has provided us with personal identifiable information, we will delete such information from our files.

Subordination to the Terms of Service

This Privacy Policy is incorporated into and subject to the terms and conditions of jibe’s Terms of Service as an integral part thereof; in case of a contradiction between any provision of the Terms of Service and the content of this Privacy Policy, the provisions of the Terms of Service shall prevail.
